We grant you a limited, non-exclusive, non-transferable license to access and use our Services for your personal or internal business purposes, subject to these Terms.
Our Services may integrate with or contain links to third-party websites, products, or services. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
HOMESENSE IS NOT A SECURITY OR SAFETY MONITORING SERVICE. WE DO NOT GUARANTEE THAT OUR SERVICES WILL DETECT ALL EVENTS OR PROVIDE TIMELY ALERTS. YOU SHOULD NOT RELY ON OUR SERVICES AS YOUR PRIMARY SAFETY OR SECURITY SYSTEM.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMESENSE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless HomeSense and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of the Services or violation of these Terms.
We may terminate or suspend your account and access to the Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services will immediately cease. Provisions that by their nature should survive termination will survive.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in San Francisco County, California.
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Services after such changes constitutes acceptance of the new Terms.
